These Terms and Conditions (the “Terms” or “Agreement”) govern your access to and use of the NYT Furniture website (the “Site”) and any purchase of products or services offered by NYT Furniture (the “Company”, “Provider”, “we”, “us”, or “our”). By accessing or using the Site and/or placing an order, you (“User”, “Customer”, or “you”) confirm that you have read, understood, and agree to be bound by these Terms and all applicable laws of the Republic of South Africa. If you do not agree, you must not use the Site.
Headings are provided for convenience only and do not affect interpretation.
1.1. The Site is an online furniture store enabling the browsing and purchase of furniture and related goods, as well as delivery and assembly support where offered (collectively, “Products”).
1.2. “Products” and “Furniture” refer to all items and services sold by NYT Furniture online and/or in-store, including without limitation furniture, mattresses, household accessories, décor, duvets, and pillows.
1.3. Illustrations: Images and renders are for illustrative purposes only. Actual products may vary slightly in colour, texture, finish, or appearance.
1.4. Weight and Size: Measurements may be taken manually. While we strive for accuracy, we are not liable for losses caused by measurement errors and do not provide shipping refunds based on size/weight discrepancies.
1.5. These Terms apply to (i) your use of the Site, (ii) all purchases made through or in connection with the Site, and (iii) the relationship between visitors, customers, and the Company.
1.6. Any purchases and any account access (if offered) are personal to you and non-transferable.
2.1. The Site may provide product listings, pricing, promotions, contact forms, purchasing options, and access to Products.
2.2. Information may be collected automatically or voluntarily when you interact with the Site, as described in our Privacy Policy made available on the Site.
3.1. If you create an account, you must provide accurate, current, and complete information and maintain the confidentiality of your login credentials.
3.2. You must notify us promptly of any suspected unauthorised use of your account.
3.3. We may suspend or terminate account access where misuse, fraud, or a breach of these Terms is suspected or identified.
4.1. We may update, modify, suspend, or discontinue the Site or any portion of it at any time, whether temporarily or permanently.
4.2. Certain services integrated with the Site (including payment processors, analytics, couriers, and marketing technologies) may be provided by third parties. We are not responsible for the performance, reliability, availability, privacy practices, or security of third-party services.
4.3. Access to and use of the Site may be interrupted due to technical issues or events beyond our control. We are not responsible for delays, interruptions, or failures arising from such causes.
5.1. The entire content of the Site (including text, graphics, logos, images, product descriptions, design elements, and code) is owned by or licensed to NYT Furniture and is protected under South African law and applicable international laws.
5.2. You may download or print portions of the Site solely for your non-commercial use or for the purpose of placing an order with us.
5.3. You may not copy, reproduce, distribute, publish, modify, display, transmit, or create derivative works from any Site content without our prior written permission, except as expressly permitted in these Terms.
5.4. All trademarks, service marks, and trade names used on the Site are trademarks or registered trademarks of NYT Furniture or their respective owners.
5.5. Unauthorized use may result in civil and/or criminal liability.
6.1. Except to the extent prohibited by applicable law, the Site and Products are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.
6.2. Where the Site includes general information, such information is provided for informational purposes only and does not constitute professional advice. You remain responsible for obtaining appropriate advice for your particular circumstances.
7.1. To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site or any Products.
7.2. Where liability is established in connection with a purchased Product, our total liability will not exceed the amount paid by you for the specific Product giving rise to the claim, except where applicable law requires otherwise.
8.1. Full Payment: Goods must be paid for in full before delivery. We may accept payment via cash, credit card or EFT (if offered/accepted at the time of purchase).
8.2. Ownership: Ownership of goods transfers to the purchaser only once NYT Furniture has received the full purchase price in cleared funds.
8.3. Price Revision / Errors: Prices are subject to revision in the event of a legitimate clerical, pricing, or sales error. Where an error affects your order, we will notify you and provide the option to proceed at the corrected price or cancel for a refund of amounts paid.
8.4. Repossession: We reserve the right to repossess goods if the full price is not paid after delivery. Repossession does not relieve the purchaser of payment obligations, to the extent permitted by law.
9.1. Lay-bys are accepted and held for a maximum period of 6 (six) months, unless agreed otherwise in writing.
9.2. If the balance is not settled within 6 months, prices may be subject to alteration, or the order may be cancelled to defray storage and administrative expenses, subject to applicable law.
10.1. Shipping Costs and Large Items: NYT Furniture reserves the right to define items as “overweight” and/or “large”. Please verify shipping costs displayed in your cart prior to checkout. We reserve the right to amend shipping costs at any time, including where a shipping quote was calculated incorrectly; in such case we will notify you and provide options as required by law.
10.2. Estimated Delivery Dates: We aim to meet estimated delivery timeframes; however, delivery dates are estimates only and we accept no liability for damages resulting from delivery delays to the extent permitted by law.
10.3. Access for Delivery / Re-Delivery: Drivers are instructed not to deliver unless payment has been finalized. If re-delivery is required due to non-payment and/or the customer’s absence or unavailability, a second delivery fee may be charged.
10.4. Storage Fees: Customers must accept delivery within 7-10 working days of the goods arriving from the factory (where applicable). Failure to do so may result in a storage fee of 10% of the selling price per month.
10.5. Cancellation Due to Delay: To cancel an order due to late delivery, the purchaser must provide a written demand giving NYT Furniture 14 (fourteen) days to effect delivery before cancellation will be considered valid (subject to applicable law).
10.6. Risk of Loss: Risk of loss for physical goods transfers to the customer once the item is handed to the shipping provider, unless otherwise required by applicable law.
11.1. Returns, cancellations, and refunds are handled in accordance with applicable consumer protection laws. Where these Terms provide specific timelines/fees, they apply to the extent permitted by law.
Unopened & Unused: Products returned in original packaging within 2 (two) days may be eligible for a refund, less shipping charges. A 30% restocking fee applies.
Opened but Unused: Products returned within 2 (two) days, in original condition, may be eligible for a refund. A 40% restocking fee applies.
Assembled (Not Damaged): If you wish to return an item that has already been assembled but is not damaged, within 2 (two) days, a 60% refund may be issued. The customer is responsible for return courier fees.
Inspection on Delivery: It is the customer’s responsibility to inspect goods upon delivery before signing the delivery note.
Visible Damage: You have the right to refuse delivery of visibly damaged products. The damage must be clearly recorded on the driver’s delivery note/documentation.
Hidden Damage: If damage is discovered after delivery, it must be reported to nytfurniture@gmail.com within 24 hours of delivery, together with photographic evidence. Returns, repairs, and/or replacements will be handled in accordance with applicable law and, where permitted, at our discretion.
Approved refunds will be processed using the original payment method, unless otherwise required by law.
12.1. Where factory guarantees apply, NYT Furniture will assist with guaranteed claims. The purchaser is responsible for delivering the item to our premises and collecting it after repair.
12.2. If NYT Furniture facilitates collection and/or delivery for repairs, standard delivery fees will apply.

We may suspend or terminate access to the Site and/or cancel orders where: (i) these Terms are violated, (ii) false or misleading information is provided, (iii) fraud, misuse, or abuse is suspected, or (iv) the Privacy Policy is violated.
15.1. Cancellation Fee: A 30% handling charge of the total purchase price will be applied to all cancelled orders, to the extent permitted by applicable law.
15.2. Entire Agreement: These Terms constitute the entire agreement between you and NYT Furniture relating to your use of the Site and your purchases. No verbal representations or guarantees are binding unless recorded in writing and signed by an authorized representative of NYT Furniture.
15.3. Legal Costs: The purchaser is responsible for all legal costs (on an attorney-and-client scale) incurred by the seller to recover monies owed, to the extent permitted by law.
16.1. These Terms are governed by, and construed in accordance with, the laws of the Republic of South Africa.
16.2. Any disputes shall be subject to the jurisdiction of the Magistrate’s Court of Johannesburg, unless applicable law provides otherwise.
17.1. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
17.2. We may assign or transfer our rights and obligations under these Terms to third parties, to the extent permitted by law.
